Rules and conditions of the prize game

1. GENERAL PROVISIONS

Lamorix d.o.o., Moste 40J, 1218 Komenda, (hereinafter referred to as the organizer) for the purpose of promoting the Lamorix brand, organizes a prize game, which will took place on the Facebook and Instagram profile. 

With these rules and conditions of the prize game, the organizer also defines the rights, obligations, and conditions for participation in the prize game.

2. DURATION OF THE PRIZE GAME

The prize game lasts from April 17, 2025 to April 22, 2025 until 23:59 hours on the Facebook and Instagram profile (Lamorix Cosmetics).

3. TERMS OF COOPERATION

By participating in the prize draw, the participant is deemed to irrevocably and unconditionally accept the Rules and conditions of participation in the prize draw.

By participating in the prize draw, participants accept and agree to the rules and conditions of the prize draw.

In the prize game, adult citizens of the Republic of Slovenia can participate, who will during  17. 4. 2025 (starting with posts) and 22. 4. 2025 (until 23:59) liked the post, followed the Facebook or Instagram Lamorix profile, and tagged at least one person in the comment. For greater chances in the draw, participants can share the Instagram post in their Instagram story or the Facebook post on their Facebook wall (newsfeed). 

Employees of the company cannot participate in the prize game LAMORIX d.o.o, and their immediate family members.

Persons under the age of 18 cannot participate in the prize game. Individuals under the age of 18 may participate in the prize game only with written consent from their parents or legal guardians for participation in the prize game and for the transmission of personal data to the organizer. Written consents from parents or legal guardians must be submitted to the organizer by individuals under the age of 18 no later than upon collection of the prize.

Participation in the prize draw is not conditional on a purchase.

4. AWARD

The organizer will award a prize in the contest:

1x Gift set Lamorix Elixir Plus and Elixir Vivid (valued at 71,90 €)

One (1) participant will be drawn as a winner on the Facebook profile and one (1) participant on the Instagram profile. Each of the winners will receive one (1) gift set of Elixir Plus and Elixir Vivid.

During the duration of the prize game, one person can receive the prize only once.

The prize is non-transferable and cannot be exchanged or redeemed for cash.

The organizer reserves the right to replace the intended prize with another for any reason.

The organizer also reserves the right to change the day and time of the start of the prize game for any reason, as well as the time of announcing the winner.

4. DRAWING AND NOTIFICATION OF THE DRAWN PERSON

The prize will be awarded based on a draw from all received likes, followers, and Facebook comments submitted during  17. 4. 2025  and  22. 4. 2025 until 23:59.

The winner draw will be on Wednesday, 23. 4. 2025, during the day. The draw will not be public. The result of the draw is final and cannot be appealed.

The drawing is done electronically, specifically in such a way that names and email addresses of all participants who meet the conditions for participation in the prize draw, enter into an electronic database, from which the winner is drawn.

The organizer or the prize draw executor will notify the drawn prize winner about receiving the prize via the Instagram platform, no later than 5 days after the draw has concluded.

By participating in the prize game, the participant agrees to the public disclosure of the winner's data on Facebook and Instagram profile @Lamorix Cosmetics.

The organizer is not obliged to respond to requests from those who have not provided their personal data in a timely manner.

The organizer bears no responsibility and does not participate in disputes regarding the ownership of the drawn prize. All disputes related to the rights concerning the ownership of the drawn prize will have no impact on the rule that the organizer awards the prize to the person whose data was provided within the framework of the prize game or was provided by an officially authorized person or legal representative on their behalf.

5. RECEIVING THE PRIZE

If the winner does not provide or submits incomplete or incorrect data and/or if the winner cannot be notified and/or if it is determined that the winner did not meet the conditions for participation in the prize game and/or violated these conditions and/or if the winner does not wish to fulfill the obligations according to these conditions, all within the deadline set by the organizer, the winner loses the right to the prize.

The condition for claiming the prize is that the winner sends the following information to the organizer in a private message within 3 days of notification: first name, last name, permanent address, phone number, and tax number.

In the event that the winner does not provide the required data on time, they lose the right to the prize, and the organizer is released from their obligation to deliver the prize to that winner.

The organizer of the prize game reserves the right not to award the prize if there is doubt about the identity of the data or it is determined that the participant took part in the prize game in violation of the rules and conditions of the prize game or drawing.

Minors and persons who have been partially or fully deprived of legal capacity can only accept the prize based on written approval from their parents or legal representative, who also represents them when handing over the prize. The written approval can be given after the winner receives the notification about the prize. Such consent also constitutes approval to participate in the prize game.

The organizer will send the prize at their own expense to the address provided by the winner. 

6. PERSONAL DATA

By participating in the prize draw, the participant agrees that the data they provide may be collected, stored, and used for internal market research and marketing purposes. This consent can be revoked at any time by sending an email to info@lamorix.com with future effect.

The organizer of the prize game undertakes to handle the provided data carefully and in accordance with applicable personal data protection regulations. The organizer will use the provided data exclusively for the purposes as stated and described in these rules, and under no circumstances will the data be disclosed to third parties, except in cases where the data is processed on behalf of the organizer by a contractual processor (IT support for the purposes of organizing and conducting the prize game, accounting service). The data will not be transferred to third countries.

The legal basis for processing personal data is the provision of point a) of the first paragraph of Article 6 of the GDPR (your consent). The withdrawal of your consent does not affect the lawfulness of processing based on consent before its withdrawal. Personal data of participants who were not drawn are deleted after the conclusion of the prize draw and the awarding of the prize, or the organizer does not store or process them for any other purposes than those stated above.

In the event that you are drawn, your name will be recorded in the draw record. The organizer will keep the draw record for 1 year or for the duration of the statute of limitations for claims arising from the prize game, unless a longer retention period is necessary due to the enforcement, execution, or defense of legal claims. The legal basis for obtaining and storing your personal data is the provision of point b) of the first paragraph of Article 6 of the GDPR. Data processing in this case is not based on your consent and therefore the processing of data does not depend on your withdrawal of consent.

Personal data of the winner who confirms the receipt of the prize (name and surname, address, tax number) are stored in accordance with tax legislation for ten years after the end of the year in which the prize was handed over. The legal basis for collecting and storing the data needed to deliver the prize (fulfillment of obligations to the winner) is the provision of point b) of the first paragraph of Article 6 of the GDPR. The legal basis for storing data needed for tax purposes, i.e., for fulfilling legal obligations applicable to the organizer, is also the provision of point c) of the first paragraph of Article 6 of the GDPR. Data processing in this case is not based on your consent and therefore data processing does not depend on your withdrawal of consent.

The organizer provides you, as an individual to whom the collected personal data relates, with all rights in accordance with the GDPR. You have the right to access your personal data, the right to rectification, the right to erasure, the right to restriction of processing, and the right to data portability. You exercise these rights by sending a request to the organizer at the email address info@lamorix.com or by mail to the published address of the organizer. Your inquiries will be processed without undue delay and free of charge in accordance with legal requirements, and you will be informed of the measures we have taken. To process your request as quickly and efficiently as possible, please specify your request as precisely as possible and also indicate the address (or email address) where you wish to receive the response. 

Without prejudice to any other administrative or legal remedy, every individual to whom personal data relates has the right to lodge a complaint with a supervisory authority, particularly in the Member State where they usually reside, where their place of work is located, or where the alleged infringement occurred, if they consider that the processing of personal data concerning them violates the GDPR. 7. TAXES AND INCOME TAX ADVANCE PAYMENT

Prizes are taxed according to the Income Tax Act. The prize winner is liable for income tax payment in accordance with the Income Tax Act (other receipts, which also include prizes). The advance income tax for the prize is calculated and withheld by the organizer of the prize draw. It follows that the prize winner is obliged to cover any additional income tax payments that burden them based on the annual income tax assessment.

Winners, as income tax payers (paragraph 2 of Article 35 of the ZDavP-2), are obliged to submit to the organizer in writing accurate personal data (name and surname, permanent residence address, tax office, their tax number, and a photocopy of the tax number), no later than 14 days from receiving the notification of the prize (or within another deadline specified in the notification). Submission of the specified data is a condition for claiming the prize if its value exceeds 42 euros including VAT. If the winner does not provide these data to the organizer within the required deadline, they are not entitled to demand the prize from the organizer. In such cases (refusal or late submission of the prescribed personal data), the organizer is released from all obligations arising from these general terms and conditions towards the winner. In this case, the prize will be awarded to another participant who will be drawn later and entitled to the prize.

9. OTHER PROVISIONS

The organizer assumes no responsibility whatsoever for:

•  non-operation of the Facebook and Instagram (Meta) platform,

• non-operation of the service resulting from incorrect use or lack of knowledge in using the services,

• non-operation of the service resulting from network outages of contractual partners, power outages, or other technical disruptions that could temporarily interfere with the use of the service,

• any adverse consequences that a participant might suffer due to participation in the prize game,

• any damage arising in connection with the acceptance and use of prizes.

Mint is completely free of all liability related to the execution of the prize game and all activities arising from it.

The prize game is in no way sponsored, supported, or conducted by Targets or otherwise connected with it.

You entrust your data to the organizer of the prize game at Facebook or Instagram.

The organizer is responsible for interpreting the rules, and by participating in the prize game, the participant accepts and agrees to these rules. The results of the draw are final and cannot be contested under these rules.

These rules constitute the exclusive rules for organizing the prize game, participating in the prize game, and awarding the prize. All other direct or indirect explanations or messages from the organizer of the prize game represent only an informative summary of these rules and information about the prize game.

In the event of violations or alleged violations of the conditions set out in these rules, each participant is liable to the organizer and/or third parties for all damages incurred, and the organizer reserves the right, in such cases, to refuse participation to the participant and/or exclude them from continuing in the prize game at any time during its duration without any obligations. This provision also applies after the prize game has ended.

The organizer assumes no responsibility whatsoever for any adverse consequences that participants may suffer as a result of participating in the prize game.

Participants in the prize draw assume full responsibility for the use of the prize they received in the prize draw.

The organizer does not bear any costs incurred by participants due to participation in the prize game.

The organizer's decision on all matters related to the prize game and its associated rules (including rules not covered in these terms and conditions) is final and binding for all participants, and no appeal is possible.

The organizer reserves the right to change the rules if required by reasons of a technical or commercial nature or reasons on the part of the public. 

10. VALIDITY OF THE RULES

The rules come into effect dno, 17. 4. 2025, from the witnessprize draw.
